Please read these Terms of Service (the “Agreement”) carefully. Your use of the Site (as defined below) constitutes your consent to this Agreement.
This Agreement is between you and IK Paradise Garden Center Ltd / G.I. Expert Gardening & More Services Ltd (“Company”, “we”, or “us”) concerning your use of (including any access to) the Company’s site currently located at https://paradisegardenscenter.com (together with any materials and services available therein, and successor site(s) thereto, the “Site”). This Agreement hereby incorporates by this reference any additional terms and conditions posted by the Company through the Site, or otherwise made available to you by the Company.
By using the Site, you affirm that you are of legal age to enter into this Agreement. If you are an individual accessing or using the Site on behalf of, or for the benefit of, any corporation, partnership, or other entity with which you are associated (an “Organization”), then you are agreeing to this Agreement on behalf of yourself and such Organization, and you represent and warrant that you have the legal authority to bind such Organization to this Agreement. References to “you” and “your” in this Agreement will refer to both the individual using the Site and to any such Organization.
Note on Consent: Notwithstanding the above, your general acceptance of this Agreement through the use of the Site does not constitute consent to the collection of personal data via non-essential cookies. Your choices regarding data privacy and cookies are governed separately by our Cookie Policy and Privacy Policy, where explicit, granular consent is required before any non-essential data processing begins.

We may, at any time and without liability, modify or discontinue all or part of the Site; charge, modify, or waive any fees required to use the Site; or offer opportunities to some or all Site users.
Information Submitted Through the Site
Your submission of information through the Site is governed by the Company’s Privacy Policy, located at https://paradisegardenscenter.com/privacy-policy/ (the “Privacy Policy”). You represent and warrant that any information you provide in connection with the Site is and will remain accurate and complete, and that you will maintain and update such information as needed.
Jurisdictional Issues
The Site is controlled or operated (or both) from the jurisdiction of the Company’s principal place of business in Cyprus, and is not intended to subject us to any other jurisdiction or law. The Site may not be appropriate or available for use in all jurisdictions. Any use of the Site is at your own risk, and you must comply with all applicable laws, rules, and regulations in doing so.

In connection with the Site, you must not:

Post, transmit, or otherwise make available any virus, worm, Trojan horse, spyware, or other computer code, file, or program that is harmful or invasive or intended to damage or hijack the operation of any hardware, software, or equipment.
Use the Site for any commercial purpose or for any purpose that is fraudulent, tortious, or unlawful.
Harvest or collect information about users of the Site.
Interfere with or disrupt the operation of the Site or the servers/networks used to make the Site available.
Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, distribute, or otherwise exploit any portion of the Site except as expressly authorized herein.
Reverse engineer, decompile, or disassemble any portion of the Site, except where such restriction is expressly prohibited by applicable law.

You are responsible for obtaining, maintaining, and paying for all hardware, telecommunications, and other services needed to use the Site.
Products & Gardening Services
The Site may make available listings, descriptions, and images of plants, trees, landscape materials, garden products, and landscaping/maintenance services (collectively, “Products”), as well as references and links to Products. Such Products may be made available by the Company or by third parties.
We make no representations as to the completeness, accuracy, reliability, validity, or timeliness of such listings, descriptions, or images (including living plant specifications, sizing, availability, and prices). Living botanical items may vary naturally in size, color, and appearance from illustrative images. Information regarding Products is subject to change at any time without notice.
Transactions & Service Requests
We make available the ability to request consultations, book landscape services, or purchase Products through the Site (a “Transaction”).
Information Submission: If you wish to complete a Transaction or request a consultation, you may be requested to supply certain relevant information, such as your name, contact phone number, property address, and billing details. You represent and warrant that you have the right to use any payment details you submit.
Service Availability & Delivery: Landscaping installations, maintenance, and plant delivery services are subject to geographic limitations (e.g., specific regions in Cyprus), weather conditions, and seasonal availability. We reserve the right to reschedule installations or deliveries due to adverse weather or logistical conditions to protect plant health and staff safety.
Cancellations & Adjustments: The Company reserves the right, without prior notice, to change or limit product quantities, adjust service pricing, or cancel scheduled consultations in accordance with site feasibility.
Registration; User Names and Passwords
You may need to register to use certain parts of the Site. We may reject, or require that you change, any user name or password you provide. Your credentials are for your personal use only; you are responsible for any use or misuse of your account and must promptly notify us of any confidentiality breach.
Submissions & Feedback
If you submit any materials, project ideas, reviews, or feedback (“Feedback”) through the Site, such Feedback will be deemed non-confidential. You grant us a worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to reproduce, display, modify, and utilize such Feedback for promotional or operational purposes without restriction or compensation.
Monitoring
We reserve the right (but have no obligation) to monitor, evaluate, alter, or remove Submissions or analyze your access to or use of the Site for operational, security, or legal compliance purposes.
Company Proprietary Rights
We and our licensors own the Site and its contents, which are protected by intellectual property laws. Trade names, trademarks, and logos associated with IK Paradise Garden Center and G.I. Expert Gardening & More Services are our proprietary property. Nothing on the Site grants any license to use our trademarks without express prior written consent.
Third-Party Materials & Links
The Site may provide access to third-party services, maps, or external tools (“Third-Party Materials”). Disclaimer of Warranties
To the fullest extent permitted under applicable law:
The Site, Products, and Third-Party Materials are made available on an “As Is,” “Where Is,” and “Where Available” basis, without warranties of any kind, express, implied, or statutory.
The Company disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose (including specific plant adaptability to specific soil or microclimates), and non-infringement.
The Company is not liable for errors or delays in plant delivery or landscape scheduling due to force majeure, bad weather, or agricultural transport restrictions.
Limitation of Liability
To the fullest extent permitted under applicable law:
The Company will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Site, Products, or landscaping services.
Your sole and exclusive remedy for dissatisfaction with the Site or Products is to stop using the Site.
The maximum aggregate liability of the Company for all claims shall not exceed the total amount paid by you, if any, to the Company to access the Site or purchase the specific product/service in dispute.
Indemnity
You agree to defend, indemnify, and hold harmless the Company and its directors, officers, employees, and agents from any claims, liabilities, costs, and legal fees arising out of your use of the Site or any violation of this Agreement by you.
Termination
This Agreement is effective until terminated. The Company may suspend or terminate your access to the Site at any time without prior notice if we believe you have violated this Agreement.
Governing Law & Jurisdiction
This Agreement is governed by and shall be construed in accordance with the laws of the Republic of Cyprus, without regard to principles of conflicts of law. You agree to the exclusive jurisdiction of the courts located in Paphos, Cyprus, and waive any jurisdictional or venue objections to such courts.
